HB77 repeals an important zoning protest safeguard that protects property owners from unwanted or harmful zoning changes. Under current law, if owners of 20 percent or more of the affected or nearby property object to a zoning change, the change can only pass with a three fourths vote of the governing body. This does not block zoning changes outright. It simply requires a higher level of agreement when a meaningful number of directly impacted property owners raise concerns.
This safeguard exists for a reason. Zoning changes can significantly affect property values, neighborhood character, traffic, infrastructure, and quality of life. The current protest provision gives those most directly affected by a zoning change a meaningful voice and ensures that controversial changes require broader consensus from elected officials. Repealing this provision makes it easier for major zoning changes to pass over the objections of nearby property owners who will bear the immediate impacts.
HB0077 weakens local protections for property owners by removing a check on zoning decisions that are unpopular with the people who live closest to the affected area. While public hearings would still exist, removing the protest provision takes away a meaningful procedural protection that ensures zoning changes with significant neighborhood opposition face a higher standard before being approved. This shifts power away from residents and makes it easier for local governments to approve controversial zoning changes without broad support from either the community or the governing body.
