Bill Description

AN ACT relating to the administration of government; providing for the election of the attorney general; designating the attorney general as a state elected official; setting the attorney general's term of office; setting the attorney general's salary; providing for filling a vacancy in the position; repealing and modifying provisions for interim appointment; providing for the application of the Ethics and Disclosure Act and other laws to the office of the attorney general and attorney general as a state elected official; amending certain provisions regarding actions the attorney general takes requiring approval of or pursuant to the direction of the governor; prescribing additional duties of the attorney general; making conforming amendments; repealing an obsolete provision; and providing for effective dates.

Notes

HB60 makes the office of the Wyoming Attorney General an elected position beginning with the 2026 general election. Under current law, the attorney general is appointed by the governor with confirmation by the senate. HB0060 changes that so the attorney general is chosen directly by voters in a statewide election and serves a four year term. This places one of the most powerful legal offices in state government directly in the hands of the people rather than the executive branch alone.

The bill also updates related statutes so they reflect the attorney general’s new status as an elected official. These changes include how vacancies are filled, how the office participates in state government functions, how the attorney general interacts with other state officials and boards, and how the office fits into existing election and ethics laws. Outdated appointment language is removed so the statutes are consistent and clear.

HB0060 strengthens the separation of powers and democratic accountability by making the attorney general directly accountable to the people instead of appointed by and politically dependent on the governor. This creates an independent statewide legal office that represents the interests of Wyoming as a whole, not the preferences of a single administration.
